1. Agreement to Terms

Koan Media Limited ("we", "our", or "us") provides the website koanmedia.io and our mobile applications, including Chakratones ("the app" or "our app"). By accessing or using our website or the app, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree, do not use our website or the app.

Our Privacy Policy (koanmedia.io/privacy) describes how we collect and use personal information. You should read it alongside these Terms.

2. Description of Services

Chakratones is a music-first wellness app featuring original compositions of soundbaths and healing sounds, including crystal bowls, Tibetan bowls, tuning forks, ambient field recordings, and binaural beats. Our content is offered in a wellness context for relaxation, stress reduction, and personal listening. We do not make any medical claims about our content.

3. Not Medical Advice – Important

Our website and app (including Chakratones) are for wellness and relaxation only. They are not intended to diagnose, treat, cure, or prevent any disease, illness, or medical or mental health condition. We do not provide, suggest, or claim any type of medical treatment or cure.

Our content is not a substitute for professional medical, psychological, or mental health advice, diagnosis, or treatment. If you have any health concerns, illnesses, or conditions, you should always seek advice from qualified medical or mental health professionals. Do not disregard professional advice or delay seeking it because of something you have seen or heard in our app or on our website.

Our services are not medical devices and are not designed or intended for use in the diagnosis or treatment of any condition. Use of our app and website is at your own responsibility.

4. Binaural Beats – Safety Warning

Binaural beats may cause drowsiness or altered states of attention in some people. In the Chakratones app, a safety warning is shown before you can access binaural beats content. You must read and close this warning before using that part of the app.

You must not listen to binaural beats (or other immersive audio from the app) while:

• Driving a vehicle
• Operating machinery or any equipment that requires full attention
• Performing any task where reduced alertness could cause injury to you or others

Use at a comfortable volume. If you experience dizziness, discomfort, or any adverse effect, stop listening immediately. You are responsible for using the app in a safe environment and in a safe way.

5. Other Health Considerations

Not all content is suitable for everyone. If you have (or have had) any of the following, or any other condition that could be affected by sound or altered states of attention, you should seek advice from a qualified healthcare provider before using our app or binaural beats: epilepsy or seizure disorders; pacemaker or other implanted devices; severe mental health conditions; pregnancy; tinnitus; or narrow-angle glaucoma. Use by children should be supervised by a parent or guardian.

If you are in a mental health or medical emergency, contact emergency services (e.g. 999 in the UK) and appropriate professionals. Our app and website are not emergency services.

6. Eligibility and Account

You may use our website and the general features of our app only if you are at least 9 years of age (or the minimum age in your country). To make purchases or subscriptions (e.g. in-app subscriptions), you must be at least 18 years old and able to form a binding contract. You are responsible for keeping your account details secure and for all activity under your account.

7. Use License and Acceptable Use

We grant you a limited, non-exclusive, non-transferable licence to access and use our website and app for personal, non-commercial use only. You may not copy, modify, distribute, sell, or create derivative works from our content or technology, or use them for any commercial purpose without our prior written consent. You agree to use our services only in accordance with these terms and applicable law.

8. Intellectual Property

All content, branding, and materials on our website and in our app (including but not limited to music, sounds, text, graphics, and software) are owned by Koan Media Limited or our licensors and are protected by copyright and other intellectual property laws. You may not remove any notices or use our content except as permitted under these Terms.

9. Subscriptions and Purchases

The published URL for these supplemental terms is koanmedia.io/terms. In-app purchases and subscriptions for Chakratones are offered and billed through third-party platforms (including the Apple App Store and Google Play) and our subscription partners (such as RevenueCat), subject to their terms and ours. Prices, subscription length, trial terms (if any), and what is included are shown in the app and on the store checkout screen before you confirm a purchase.

Paid offerings in the app may be labelled Premium Monthly, Premium Yearly, and Premium Lifetime (names and availability as shown in the app). Premium Monthly and Premium Yearly are auto-renewing subscriptions. Premium Lifetime is a one-time, non-recurring payment (not a subscription), as set up in the Apple App Store, Google Play, and RevenueCat. Pricing and product type are displayed on the subscription screen before you confirm.

For apps obtained through the Apple App Store, Apple's standard Licensed Application End User License Agreement (EULA) applies to the grant of the app licence, as linked at the top of this page; these supplemental Terms govern our services and content as described here.

9.1 Apple App Store (iOS, iPadOS, visionOS where applicable)

If you buy an auto-renewing subscription (for example Premium Monthly or Premium Yearly) or other paid content through the Apple App Store, the following applies (in addition to Apple's terms and the information shown at purchase). These auto-renewal terms do not apply to Premium Lifetime, which is a one-time purchase only.

• Payment: Payment will be charged to your Apple ID account at confirmation of purchase.
• Auto-renewal: The subscription automatically renews unless you turn off auto-renew at least 24 hours before the end of the current period.
• Renewal charge: Your account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price unless otherwise shown.
• Managing subscriptions: You may manage or cancel subscriptions and turn off auto-renewal in your Apple ID account settings on your device (for example Settings → Apple ID → Subscriptions) or as Apple otherwise provides.
• Free trial: If we offer a free trial, its length and conditions are shown in the app and at purchase. When you subscribe after or during a trial, any unused portion may be forfeited or handled as stated at purchase, in line with Apple's rules.

How we handle personal data is set out in our Privacy Policy (koanmedia.io/privacy), which you should also use for App Store Connect and in-app links where applicable.

9.2 Google Play (Android)

Purchases through Google Play are subject to Google Play's terms and the purchase flow shown in the Play Store. You can view, change, or cancel subscriptions in your Google Play or Google account settings (for example Payments & subscriptions). Premium Lifetime is a one-time purchase and does not renew. Renewal timing and cancellation for subscriptions work as described by Google at purchase.

9.3 Refunds, changes, and general

Refunds are handled according to the rules of the store where you bought the item (Apple or Google) and any additional policy we publish where permitted. We may change pricing or features with notice where required by law or store rules. If you have billing questions, contact us at hello@koanmedia.io and the relevant app store support channel.

10. Disclaimer

Our website and app are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or free of harmful components. You use our services at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, Koan Media Limited and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of our website or app (including binaural beats or other content), even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you have paid us in the twelve months before the claim (or £50 if you have paid nothing). Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by law.

12. Links and Third Parties

Our website or app may contain links to third-party sites or services. We do not endorse and are not responsible for the content or practices of third parties. Your use of third-party services is at your own risk and subject to their terms and policies.

13. Modifications

We may update these Terms of Use at any time. We will post the updated version on this page and update the "Last updated" date. Continued use of our website or app after changes means you accept the updated terms. If you do not agree, you must stop using our services.

14. Governing Law

These Terms of Use are governed by the laws of England and Wales. You irrevocably submit to the exclusive jurisdiction of the courts of England and Wales for any dispute arising out of or in connection with these Terms or your use of our services.
